These Terms and Conditions (“Terms”) govern your access to and use of the GiftLyst platform, website, and related services (collectively, the “Service”). GiftLyst is a service offered by Porosi Procurement Limited, a company registered and operating in Jamaica (“Porosi”, “we”, “us”, or “our”).

By accessing or using GiftLyst, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or make purchases on GiftLyst. By using the Service, you confirm that you meet this requirement and that all information you provide is accurate and complete.

2. Description of the Service

GiftLyst is an online gift registry platform that allows users (“Recipients”) to create registries and add items from supported retailers. Other users (“Givers”) may purchase gifts from these registries. GiftLyst facilitates the purchasing, logistics coordination, and delivery or pickup of items on behalf of Recipients.

GiftLyst does not manufacture or own the products listed on registries.

3. Accounts

3.1 Account Registration

Recipients and Givers must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Updates

Gift givers create accounts to receive order confirmations, shipping updates, and delivery notifications related to their purchases.

4. Fees and Payments

4.1 Recipient Fees

GiftLyst is free for Recipients. There are no registration, subscription, or platform fees charged to Recipients.

4.2 Giver Payments

All product costs, shipping, handling, delivery fees, taxes, and any applicable Customs charges are paid by the Giver at checkout.

4.3 Payment Processing

Payment information is processed securely at the time of purchase through a third party processor. GiftLyst does not store payment details for future use.

5. Anonymous Gifting

GiftLyst allows Givers to select an anonymous gifting option. When selected, the Recipient will not be informed of the Giver’s identity.

6. Delivery and Pickup

6.1 Delivery

Recipients may choose delivery to a specified address and may schedule a preferred delivery date where applicable. Delivery timelines are estimates and may vary due to supplier availability, shipping delays, customs processing, or external factors.

6.2 Pickup

Where available, Recipients may choose to collect items from a designated pickup location provided by Porosi Procurement Limited.

6.3 Third-Party Logistics

GiftLyst may utilize third-party logistics providers for all inbound shipments. Porosi is not responsible for delays or failures caused by circumstances outside of its reasonable control.

7. Product Availability and Substitutions

Product availability is subject to change. If an item becomes unavailable after purchase, GiftLyst may contact the Giver or Recipient to arrange a replacement, alternative item, or refund, where applicable.

8. Cancellations and Refunds

Once a gift has been purchased and processing has begun, cancellations or refunds may not be possible. Refunds, where applicable, are subject to the policies of the retailer and logistics providers involved.

9. User Conduct

You agree not to:

* Use GiftLyst for unlawful or fraudulent purposes
* Provide false or misleading information
* Interfere with the operation or security of the Service
* Attempt to access accounts or data not belonging to you

We reserve the right to suspend or terminate accounts that violate these Terms.

10. Intellectual Property

All content, trademarks, logos, designs, and software associated with GiftLyst are the trademarked property of Porosi Procurement Limited and may not be used without prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Porosi Procurement Limited shall not be liable for indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

GiftLyst provides the platform “as is” and makes no guarantees regarding uninterrupted or error-free operation.

12. Indemnification

You agree to indemnify and hold harmless Porosi Procurement Limited from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Privacy

Your use of GiftLyst is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be effective once posted on the website. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Jamaica.
